Owed what? Certainly not the opportunity to ship such a risky title, as Activision Blizzard doesn't seem interested in publishing anything but the safest of safe properties. Variety theorizes, quite logically, that Activision simply wants to get money from EA.

Or maybe Activision simply thinks that since Double Fine founder Tim Schafer believes that Brütal Legend's existence was partially due to the success of Guitar Hero, there's some royalty owed. We're not lawyers!

According to what we'd heard, Double Fine was under the impression that it was free to find another publisher, after the title contractually slipped through Activision's fingers. That publisher eventually turned out to be Electronic Arts.

EA told Variety that it doesn't expect to be hit with a lawsuit, as that would be as ridiculous as "a husband abandoning his family and then suing after his wife meets a better looking guy." Oh yes. They said that. Variety has the full statement.

Oh god no, I will fucking kill them if they interfere with this release. They are assholes to have dropped it in the first place, and now they are screwing with EA for trying to publish it? Seriously, I WILL KILL.

Well, on the one hand, I'm actually surprised that there wasn't a payout already. If a company cans a release, a lot of times they will sell it to another company to recoup what they paid into it. That said, if BL became a free agent because of an expired contract, as this article seems to imply, I don't think they have a leg to stand on. But then again, when has kotaku ever known what the fuck they were talking about?

For the first time in a long time, I hope EA wins this lawsuit. Once they win, they should counter-sue Activision for being retards.

I have a feeling Activision might be doing this because they actually want the game back. It was stupid to cancel it, and it might even mesh with the Guitar Hero brand, and they really only canned it as part of their posturing as the dominant company in the merger.

I can't say who's right because I don't know what their contract said.

I hope that they want the game back and release it as opposed to suing EA just to get some money for squatting on an IP.

:goodpost: I agree with you, Frog. Activision is being rather assy these days, and is acting just like EA in its crappy prime. Odd, that. Seems being in 1st place for third parties does that to you. XD

I hope all of this won't affect Brutal Legend from being released. Activision does seem to be the bad guy in this scenario, but I don't know any details. That was a crafty comment by EA though, lol
